The sixth meeting of the Conference of the Parties to the Basel Convention held in December 2002, in decision VI/24 , requested the Open-ended Working Group to present recommendations on the legal aspects of the full and partial dismantling of ships to the Conference of the Parties at its seventh meeting. Consequently, at its second meeting, the Open-ended Working Group identified, in decision OEWG-II/4 , a number of questions and issues relating to the legal aspects of the dismantling of ships in respect of which it sought comments from Parties and others.
The Open-ended Working Group also established a small inter-sessional working group on this subject. Many Parties and other stakeholders submitted comments , which were presented to the Open-ended Working Group for consideration. At the third meeting of the Open-ended Working Group, a work programme for the inter-sessional working group was adopted, setting out a process by which recommendations could be formulated in respect of the legal aspects of the full and partial dismantling of ships.
The seventh meeting of the Conference of the Parties to the Basel Convention held in October 2004,in decision VII/26 on the environmentally sound management of ship dismantling, requested the Open-ended Working Group to consider the practical, legal and technical aspects of the dismantling of ships in the context of achieving a practical approach to the issue of ship dismantling, to report on developments and to present any proposals, as appropriate, to the Conference of the Parties at its eighth meeting on a legally binding solution.
